What the ANN article fails to mention is that this guy was out on probation for raping lolis in the real world when he imported the manga.
Was he found guilty for breaking probation or for importing loli manga? If it’s the latter, which the article in my opinion suggests, it doesn’t matter what he did before. The article makes it sound as if 100 hours community service and now even jail time is praxis in cases where people have imported loli manga.
The interesting question is where they draw the line between doodles, works with artistic merit and child pornography. What’s even more interesting is how they can argue whether a character is 16 or 18 without making a fool of themselves.

I think that is bull why should a man getting in trouble for have some graphic comics of lolis be sentenced to that. I myself am a anime/manga fan(who also likes loli art as long as it doesn’t have old dudes in it/them) and yeah canada is free but we also have some f*cked up laws and people. Sh1t its only a drawing its not like its real and is going on in every house. People who do sh1t to kids thats them not everyone we should be able to read/enjoy what we want to!

Point 1: The age issue. Most loli anime and manga don’t give a specific age for their loli characters. That being said you could by all rights claim that the characters are just underdeveloped 18 year olds.
Point 2: It’s just cartoons. Kiddy porn laws were made to protect underage children from abuse but looking at loli hentai puts no little children in any kind of danger.
Point 3: Hentai = Kiddy porn. From another point of view most hentai depicts high school girls under the age of 18. So under this condition a vast majority of hentai should be banned from Canada.

Odds are this guy just was ignorant of the laws against cartoon porn.
However… didn’t he have real CP too? No way he’s ignorant of that. He should be convicted for breaking the law there. Even if it’s kind of a BS law (it should be illegal to fund it, but not to steal/share it) it’s still the law and you should obey it. It obviously shows a lack of control there.
That being said, it still sucks using lolicon stuff to compound criminal charges. Sure, stack as much as possible on a sentence, but do it with legitimately bad stuff with some kind of apparent victim. The law was written to avoid stuff like people professionally sketching CP images of real kids, not for entirely fictional stuff made up of popular characters like Cardcaptor Sakura we all know is fake. I can’t think of any manga/anime-style drawn character you’d ever confuse as real.

I have studied this case more indepth since initially responding to it. It has come up on Wikipedia. The initial source of the report is the Anime News Network, who got it from news reports which have since no longer been hosted on the internet.
This guy did NOT have any IRL CP. It was ONLY lolicon. That’s it. Or maybe some shota too, I dunno, but essentially, JUST cartoon images.
Also, the initial report of this post says all lightheartedly “oh no, 18 months without internet, 100 hours community service, $150, worth it?”
It’s not. Not unless you’re doing it to stand for something and don’t mind upsetting your life. Firstly, this man was put on a Sex Offender registry for 5 years. 60 months. This will interfere with employment, and basically, it’s going to give people a reason to go after you. I don’t think sex offender registries are public like they are in the United States, but a lot of people are moving to make it this way.
Hopefully if that happens, it will only apply to future cases, as in people put on the registry after they decide to make it public, but that is NOT a guarantee. People will use this data to harass you and possibly threaten your life. I know because even in the absence of such registries, people are more than willing to do this if they just link up your views online regarding lolicon with your real life identity, even if you’ve never commited any crimes at all! It would only get worse as a sex offender.

You will note something in this: “New laws, in effect November 1st will require mandatory Jail time for Canadians convicted of importing child porn.”
This would be applicable to lolicon. Basically, since he was sentenced October 20th, he just missed the bill. This isn’t a matter of a wad of cash, community service and a registry anymore, but also your freedom and your record. It’s a jailable offense now.
Since it is for ‘importing’ then I guess in theory as long as it was made in Canada or if you made it yourself it’d be okay, but I don’t know how interested the police would be in the truth. As far as I’m concerned, a police officer has the potential to be as bigoted as the rest of the population. They want their convictions, they want to look good.
You might think ‘how will they get a warrant’. How well do you all protect your online identities? Do you have enemies? If anyone even has a suspicion, that could be grounds enough for a warrant. Warrants are given easier than credit cards these days. Police don’t want to search a home unless they’re guaranteed to find something. I think they will bring lolicon with them, and put it on your computer. This way, if they don’t find anything else (maybe you don’t have any, maybe they think you do but it’s hidden) then they’ll ‘find’ what they brought, and convict you for it.
This is why computer data should not be admissable as evidence in court. This is why media should not be illegal. It is too easy to bend the truth for people’s secret motivations.
Its legal to own it but not legal to import or export it out of Canada
