   There were some good comments on digg. Especially this one.

   I always wonder in these cases, if the younger party (male or female) were to come forward and say, “I was willing…I agreed to all relations…I knew what I was doing etc” would that be taken into consideration?

   I tend to agree with Simonetta Matone, a judge in the article who says that, “Every relationship is a relationship and the real maturity, whether physical or psychological, of the minor must be weighed, with the help of experts.”
   According to the EJI (http://www.eji.org/eji/reports/cruelandunusual), they have documented 73 cases in the U.S., where 13 and 14 year-old children have been tried as adults, mostly for violent crimes. So is the message we are trying to send; teenagers understand violence but not sex?

   Whether we would like to admit it to ourselves, there are female teenagers who are intentionally sexually active (engaging in sex with no external pressure from others) and intentionally seeking sexual partners (be they younger or older men or women).

   I feel there should be a standard test or procedure to gauge all such interactions. It should be able to discern maturity levels, mutual consent, sexual behaviour and understanding between both parties.

   The articles states the 13 year-old girl sent a “stream of torrid text messages”. Do we automatically dismiss her actions as “Oh she’s too young! She didn’t know what she was doing?” If she had instead shot and killed someone, would we be saying the same thing?

    You have to realize, however, that in italy age of consent is 14 (general case), 13 (if the lover is 16 or less) or 15 (for parents, instructors etc.), so the guy was just 1 year early.

    I’m not sure how to compare it, but there is something I’ve been seeing in the country I live.
    It’s become more and more common, and just about instantly acceptable for girl of 15 or so to start dating guys in their early 20’s.
    Now, the age difference itself isn’t a problem, but just how mature the girl in question is. This may have been one of the few times where we see a court take that into consideration.

    Couldn’t then the whole age-of-consent deal be thrown out and let everything be handled on a case by case fashion?

    I remember reading once a judge’s pre-sentencing speech in a case where a guy had been convicted of having sex with a 14yo girl (in the UK). He described the criminal acts of so-called “grooming” that the guy had performed, which included such heinous things as befriending the girl, winning her confidence by being kind and sympathetic, giving her presents, takind her out to places, and so on. FOR FUCK’S SAKE, THIS IS WHAT GUYS ARE SUPPOSED TO DO TO GIRLS, ISN’T IT????     The age of consent, like all other age restrictions, is arbitrary and can appear as unfair and draconian in nature. It’s only natural to assume that some people mature faster than others, some probably never mature at all. People don’t magically mature over a day.

    In the perfect world where everything is scientifically measurable, age of consent laws would be superfluous. But since maturity isn’t measurable, would you want to put your life in the hands of the whim of a judge or a jury? A maturity assessment could go either way.

    The age of consent exists for predictability. Remove it and getting involved with girls in the 16-20 age bracket would be like playing russian roulette.

    Considering what seems to be the trend now a days where girls, and kids in general, seem to be exploring in the sexual realm much younger than before, I don’t think it would be such a bad idea to have an alternative for the AoC laws.

    Pushing the age down wouldn’t do all that much, but I think what should really be taken into account is the testimony of the girl (or boy…yeah right) in question; Like: is the girl the one pressing charges or is it the parents only against the wishes of the “child”?
    I could list off a couple more questions a court should consider in these delicate cases because considering how easy it seems to be to get on the Sex Offenders List, which pretty much screws you for life, I’m of the school of thought that these matters so no longer be done in such an arbitrary way.

    @El Mex: well, we’re still talking about having sex with lolis, which is right on topic. So, I’m going to throw this one in, which is pretty much on the same subject. It’s from the respected journal “American Psychologist”, and an article by the Crimes Against Children Research Centre at the University of New Hampshire.     Yeah, in my experience watching sex offender shows on date line and whatnot, none of the people (If you want to call them that… most of them are very creepy looking imo >_>) ever use deception in the first place. They pretty much say they’re over age from the beginning.

    Also, this is totally random, but there’s this sophmore at my school who looks like she’s in 6th grade and it’s sooooooooooooooooooooo hot @_@

    El Mex loosen up on the purse strings and go buy some good candy. The lolis will follow. Especially candy corn trails I have noticed!
    Though those ones tend to mug me for candy leaving body in alleyway to heal, or not.
    I expect abq does read this though whether his reaction is amusement or “omg, what have I done!” I have no idea. Probably to much studying and writing for his professors to actually respond as he might wish. Have a couple of lawyers in family and their field is business bit they sure don’t have 9 to 5 hours and I can only imagine that if his am is criminal law (unfortunate term, no?) then I doubt that there is any time that isn’t work time.

    lol, her name’s Piper (Not sure if I spelt that right >_>). She’s around 4′8 and she’s most definantly an A cup. She has long brown hair. She used to be friends with my sister when I was in like 2nd grade (she was in 1st) and one time she just randomly kissed me. I doubt she remembers but yeah… when she became a freshman last year I was like “Oh yeah! I remember her… hot.”. I haven’t spoken to her at all since she got in high school though. My friend keeps on encouraging me to just go up to her and be like, “Hey, wanna have sex?” lmao. I’m sure that’d totally work.

    aussie wine… Now we know why the empire is gone. Not familiar with anything brewed from there well outside of Paul Hogan’s old TV show but hoping it isn’t filtered through a dingo’s kidneys.
    My daughter’s friends and co-conspirators (unindicted) would raid the freezer for vanilla ice cream to make Guiness floats asafter having filched the Stout during a party. Ever put up with 3 early teens half out of their nighties with a bad case of the giggle then upchuck on the dads? Kind of killed any thoughts that one of my friends had. Me, I git the honor of cleaning up after them… Everyone else including the mommy bailed immediately. Also no vanilla left so no Guiness float for me.
    Don’t grouse if you haven’t bagged your quota of lolis by the 14th. (oh come on you didn’t think I would let that one pass now did you!?)

    BTW, this is basically how it’s been working in Japan at the moment as well.

    Prefectural laws (except Nagano pref.) place the age of consent at 18, but judges have been frequently giving not guilty verdicts when concluding that couples are in a “serious relationship.” (e.g. especially if the two are engaged)

    (There is a separate federal law that punishes for age 13 or under as rape no matter what, though.)
